Terms of Sale

Please read these terms of sale carefully before placing your order.

1. Formation of the contract

1.1 These terms of sale apply to all goods supplied by us, TheTruffle Limited, including but not limited to fresh truffles, and preserved truffle products.

1.2 No contract exists between you and us for the sale of any goods until we have received your fresh truffle / truffle product order and a confirmation of that order, which may be printed by you, has been displayed on your computer monitor screen. Once you have received this confirmation, there is a binding legal contract between us.

1.3 The contract is subject to your right of cancellation (see below).

1.4 We may change these terms and conditions of sale without notice to you in relation to future sales.

2. Description and price of the goods and/or services

a. Retail orders placed via the web site
2.1 The description and price of the goods and/or services you order (including but
not limited to caviar, fresh truffles, frozen truffles and preserved truffle products) will be as shown on our website at the time you place your order.
2.2 The goods and/or services (including but not limited to caviar, fresh truffles, frozen truffles and preserved truffle products) are subject to availability. If on receipt of your order the goods you have ordered are not available in stock, we will inform you by email or by telephone as soon as possible, and offer you an alternative product or refund or re-credit you for any sum that has been paid by you for the fresh truffle / truffle product goods and/or services.
2.3 Every effort is made to ensure that truffle and product prices shown on our website are accurate at the time you place your order. If an error is found, we will not be under any obligation to supply the goods (including but not limited to caviar, fresh truffles, frozen truffles and preserved truffle products) to you at the price shown on our website at the time you placed your order. We will however inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your caviar, fresh truffle, frozen truffle or truffle product order. If you cancel, we will refund or re-credit you for any sum that has been paid by you for the goods and/or services (including but not limited to caviar, fresh truffles, frozen truffles and preserved truffle products).
2.4 In addition to the price, you may be required to pay a delivery charge for the goods. The delivery charge for your goods is shown in full in your cart or at the checkout prior to paying.
2.5 The prices on this website are prices relevant to consumers. If you are a trade / wholesale partner of TheTruffle Ltd, you should contact us for wholesale prices of the goods or services you are interested in (including but not limited to caviar, fresh truffles, frozen truffles and preserved truffle products).
2.6 Discounts and special offer prices offered on this website are subject to availability and may change without notice.
b. Trade / wholesale orders placed via email responding to a quotation
2.1 The description and price of the goods and/or services including but not limited to fresh truffles, frozen truffles and preserved truffle products) you order will be as shown on our quotation.
2.2 The goods and/or services are subject to availability including but not limited to caviar, fresh truffles, frozen truffles and preserved truffle products). If on receipt of your order the goods you have ordered are not available in stock, we will inform you by email or by telephone as soon as possible, and offer you an alternative product or refund or re-credit you for any sum that has been paid by you for the goods and/or services.

2.4 In addition to the price, you may be required to pay a delivery charge for any goods. The delivery charge for your goods will be included in your quotation.

3. Payment

a. Retail orders placed via the web site
3.1 Payment for the goods and/or services (including but not limited to caviar, fresh truffles, frozen truffles, and preserved truffle products) and delivery charges can be made by any method shown on our website at the time you place your order.
b. Trade / wholesale orders placed via email responding to a quotation
3.2 We will email an invoice to you shortly after dispatching your goods or providing your goods and or service including but not limited to fresh truffles, frozen truffles and preserved truffle products). All invoices shall be paid by within thirty (30) days of the date of invoice unless otherwise agreed in writing by TheTruffle Ltd. In the event of late payment, we may charge interest on the outstanding amount and costs of debt recovery.
3.3 Legal ownership, or title, to the goods will not pass from TheTruffle Ltd to the buyer until the buyer has paid for the goods, including but not limited to fresh truffles, frozen truffles and preserved truffle products).
3.4 TheTruffle Ltd reserves the right to increase a quoted fee in the event that the client requests a variation to the work agreed. 3.5 Our preferred payment method is bank transfer (BACS). Our bank details are on our invoices. You may also make payments by credit / debit card using the link on our invoice or by cheque to the address given. You can make payment to us over the phone, but the charges will include an additional 2% of the invoice total, to cover processing charges.

4. Delivery

a. Retail orders placed via the web site

4.1 Details of delivery methods, prices and signature requirements are given on our web site.

Saturday deliveries, and deliveries to some locations are made by Royal Mail Special Delivery Service. This service requires the recipient to physically receive and sign for their order. Orders delivered by Royal Mail cannot be left in a safe place or delivered to a neighbour.

b. The Customer is responsible for ensuring receipt of their delivery

The Customer is responsible for ensuring receipt of their delivery. This includes, but is not limited to, ensuring someone is available to sign for deliveries, monitoring delivery progress and tracking, recovering from a allocated "safe place" or neighbour.

c. Trade / wholesale orders placed via email responding to a quotation

4.2 Details of delivery methods, prices and signature requirements will be included in your quotation.

5. Gift vouchers

5.1 When available, Gift vouchers can be used in payment for the specified goods or event places online at www.thetruffle.co.uk.

 

5.2 To use your gift voucher code, please select your goods or events and enter the voucher code on the basket or checkout page.

 

5.3 Gift vouchers cannot be used for the purchase of other gift vouchers.

 

5.4 Gift vouchers cannot be exchanged for cash or returned under our Return and Refund policy or cannot be sold or re-tendered. This will not affect your statutory rights.

 

5.5 All gift vouchers hold an expiry date, please refer to your voucher for further information.

 

5.6 TheTruffle Ltd reserve the right to decline or withdraw gift vouchers and the right to amend these terms and conditions at any time and to take appropriate action, including the cancellation of gift vouchers, if, in its discretion, it deems such action necessary

6. Your right of cancellation

Our Return and Refund Policy gives full details of returns, refunds and exclusions.

7. Data protection

Please read our Privacy Policy, which explains how we use and protect the
information that you provide to us.

8. Applicable law

These terms and conditions of sale and the supply of the goods and/or services
including but not limited to fresh truffles, frozen truffles and preserved truffle
products) will be subject to English law, and the English courts will have jurisdiction
in respect of any dispute arising from the contract.
